Terms and conditions
These terms and conditions apply to all orders and agreements between you and Link A Tap.
1. Identity of the seller
Link A Tap
Saturnusstraat 21
2402 AD Alphen aan den Rijn, Nederland
Chamber of Commerce: 33235351 — VAT: NL002093851B89
2. Applicability
These terms apply to every offer and every agreement between Link A Tap and the customer concluded via this website. By placing an order you accept these terms. Any deviating arrangements only apply if agreed in writing.
3. The offer
All prices on the website are in euros, excluding VAT, unless stated otherwise. Shipping fees are shown separately before the payment step. The offer may include limitations or special conditions; these are stated explicitly. We are not bound by obvious mistakes or typing errors.
4. The agreement
The agreement is concluded the moment you place an order and the payment via Stripe is successful. You immediately receive a confirmation email containing a tracking link and an invoice in PDF.
5. Made-to-order and exclusion of the right of withdrawal
The cards delivered are produced according to your specifications (logo, name, destination, orientation). For that reason the statutory consumer right of withdrawal under Article 6:230p sub f of the Dutch Civil Code is excluded. After production you can therefore not return or rescind the order, except in the case of defects as described in article 9.
6. Cancellation by the customer
You can cancel an order free of charge as long as no shipping label has been created. You can cancel via the tracking link in your order confirmation. Once the label has been created, cancellation is no longer possible and you must contact us for resolution.
7. Delivery
Orders are printed in the Netherlands and shipped via PostNL (handled through MyParcel). Delivery times are indicative: standard shipping usually takes a few business days; express shipping within the Netherlands is generally next business day before 12:00. Delays caused by the carrier do not entitle you to compensation or rescission, except where the law provides otherwise.
The risk of damage or loss during transport passes to the consumer at the moment of delivery. For business customers the risk passes at the moment the goods are handed over to the carrier.
8. Availability of the redirect service
The NFC card and QR code point to a web address operated by Link A Tap that redirects to the destination you choose. We charge no subscription fees for this redirect service — the card is a one-time purchase. We make reasonable efforts to keep the service available for as long as Link A Tap is active, but we do not guarantee uninterrupted availability. Short periods of unavailability due to maintenance, outages or force majeure do not give rise to a right to a refund or compensation.
8.1 Temporary suspension of activities. If we temporarily suspend our commercial activities — for example due to holiday, illness or personal leave — the redirect service remains available as long as the infrastructure is functioning normally. Temporary suspension of order activities does not affect the operation of cards already delivered.
8.2 Transfer to a third party. We reserve the right to transfer Link A Tap and its associated redirect service, including customer data, to a third party — for example in case of acquisition or sale. The rights and obligations under this agreement then pass to the acquiring party; the version of these terms in force at the time of your order continues to apply to your order. We notify customers at least 30 days in advance via the last known email address.
8.3 Permanent termination. If Link A Tap permanently terminates the service — for example due to closing the business, financial necessity or absence of a successor — we will, insofar as reasonably possible, give notice at least six months in advance via the last known email address. On request we provide an export of the destinations of your cards so that you can migrate to an alternative service. Termination of the service does not give rise to a refund of the original purchase price, save where mandatory law provides otherwise.
8.4 Internet connection during use. The NFC tap and QR code operate through a redirect and require the end user's device to have a working internet connection (mobile data or Wi-Fi) at the moment of tapping or scanning. The absence of coverage or data connectivity on the end user's side — for example in a basement, in remote locations or when mobile data is disabled — is outside our control and does not give rise to a right to a refund, replacement or compensation.
9. Payment
Payment is made in advance via Stripe (iDEAL, credit card, Bancontact and other supported methods). We do not receive payment data; these are processed directly by Stripe.
10. Warranty and complaints
We warrant that the cards conform to the agreement and to the specifications you approved during ordering. Complaints about the delivered cards must be reported in writing within two months of discovery via the contact page, with a clear description and preferably a photo. In case of a justified complaint the order is reproduced free of charge or the amount is refunded.
11. Liability
Our liability is limited to the amount of the relevant order. We are not liable for indirect damage, consequential damage, lost profits or non-material damage. This limitation does not apply in case of intent or gross negligence on our part, nor where the law excludes such limitation.
12. Intellectual property
By uploading a logo or image, or by having an AI logo generated and put into production, you declare that you have the right to use this material and to have it printed on the cards. You indemnify Link A Tap against third-party claims regarding infringement of intellectual property rights, image rights or trademark rights. Copyright in material you supply remains yours.
13. Force majeure
In the event of force majeure — including problems at suppliers, printers, carriers, or outages of payment or email services — we are entitled to suspend delivery for as long as the force majeure continues. If the force majeure continues for more than thirty days, both parties may terminate the agreement without any obligation to pay damages.
14. Personal data
Our privacy statement applies to the processing of personal data.
15. Applicable law and disputes
These agreements are exclusively governed by Dutch law. Disputes are submitted to the competent court in the district where Link A Tap is established, except where mandatory law provides otherwise. Consumers in the EU may also use the European Commission's ODR platform for online dispute resolution.
16. Changes
We may update these terms and conditions from time to time. The version applicable to an order is the one in effect at the moment you placed the order.
